内容提要，几乎所有的刑法学教科书和传统的刑法学理论对所谓犯罪客体作了如下表述：犯罪客体是指为我国刑法所保护而为犯罪行为所侵犯的社会主义社会关系，并认为一切犯罪都必然侵犯一定客体。不侵犯任何客体的行为就不会危害社会，也不能认定是犯罪。犯罪客体帮助我们正确的确定犯罪的性质，因此，犯罪客体是犯罪的基本构成要件之一。然而这样一个概念，能否揭示犯罪客体的应有本质和固有属性，给犯罪客体在犯罪构成中如此定位能否说明犯罪的性质？所有这些问题在我们看来大有可疑之处。第一传统的犯罪客体理论首先把犯罪客体视为一定的社会关系，并认为是被刑法所保护的而为犯罪行为所侵犯的社会关系。然而何谓社会关系，马克思，恩格斯曾经指出：“生活的生产无论是自己生活的生产（通过劳动）或是他人生活的生产（通过生育）立即表现出双重关系：“一方面是自然关系，另一方面是社会关系；社会关系是许多个人的合作。”列宁也指出：“人与人的关系既社会关系是人们在生产和共同生活活动过程中所形成的人于人之间的相互关系。”
