The goal of establishment of the socialist market economy system has put forward new requirements for the legislation of private international law in our country。
   In order to reconstruct and perfect the legislation of private international law of our country, scholars have advocated various standpoints such as the so called Convergency Theory, Characteristic Theory, and so on。
   The differences between those standpoints are derived from, one the one hand, the influence of different social thoughts of philosophy, and the different emphasis aspects of their perspectives on the other hand。
   Based on the knowledge of the complexity of the Chinese social reality and the particularity of the private international law, the legislation of China’s private international law should stick to the Two Points Theory, namely, with Chinese characteristic and with reference to the general practice in the international community, both of which shall be combined organically instead of being bias to one or the other。
